Personal Data

While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you (“Personal Data”). Personally identifiable information may include, but is not limited to:

We may use your Personal Data to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or the instructions provided in any email we send.

Do Not Call (DNC) Compliance Policy

 A: Introduction and Purpose

American Family Assets, LLC ("the Company") is committed to full compliance with all applicable federal and state laws and regulations governing telemarketing and telephone solicitations, including but not limited to the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule (TSR), and state specific Do Not Call (DNC) laws.

The purpose of this Do Not Call (DNC) Compliance Policy ("Policy") is to establish the standards and procedures that ensure the Company and its representatives conduct all telemarketing activities in a manner that respects consumer privacy preferences and adheres strictly to legal requirements.

This Policy applies to all employees, independent contractors, agents, vendors, and any third parties conducting telemarketing activities on behalf of American Family Assets (collectively referred to as "Company Representatives").

B. Policy Statements

  1. Honoring the National DNC Registry: The Company will subscribe to and access the National Do Not Call Registry as required by law. Company Representatives shall not initiate any telephone solicitation to any telephone number listed on the National DNC Registry unless a valid exemption under federal or state law applies, such as an Established Business Relationship (EBR) or Prior Express Written Consent (PEWC) and provided the consumer has not made an entity-specific DNC request to the Company. Calling lists will be scrubbed against the National DNC Registry at least every 31 days.

  2. Maintaining an Internal DNC List: The Company shall maintain and enforce an internal, entity-specific DNC list ("Internal DNC List") containing the telephone numbers of consumers who have requested not to receive future telephone solicitations from or on behalf of [Company Name] 

  3. Consumers may request placement on the Internal DNC List by.

  4. All such requests will be processed promptly, and the telephone number will be added to the Internal DNC List within a reasonable time, not to exceed [e.g., 10 business days, but no more than 30 days] from the date of the request.

  5. ○ Telephone numbers placed on the Internal DNC List shall be maintained for at least five (5) years from the date of the request, or longer if required by applicable law, unless the consumer makes a subsequent affirmative request to be removed from the list.

  6. ○ No telephone solicitations shall be made to any number on the Company's Internal DNC List.

  7. Obtaining Valid Consent: The Company will obtain the appropriate level of consumer consent before initiating telemarketing communications, as required by the TCPA, TSR, and applicable state laws.

  8. ○ Prior Express Written Consent (PEWC) will be obtained for all telemarketing calls made using an Automatic Telephone Dialing System (ATDS) or an artificial or prerecorded voice to any wireless telephone number, and for all telemarketing calls using an artificial or prerecorded voice to residential landlines.

  9. ○ PEWC documentation will clearly and conspicuously disclose that the consumer authorizes [Company Name] to place telemarketing calls/texts to the number provided using automated technology, that consent is not a condition of purchase, and will identify [Company Name] as the sole party for whom consent is granted, in line with one-to-one consent principles where applicable.

  10. ○ Records of all consents will be maintained in accordance with Section B.8 of this Policy.

  11. Calling Time Restrictions: No Company Representative shall initiate any telephone solicitation to a residential telephone subscriber before 8:00 a.m. or after 9:00 p.m. (local time at the called party's location), unless the called party has provided prior express consent for calls outside these hours, or stricter state-specific calling time restrictions apply, in which case the stricter restrictions will be followed.

  12. Caller Identification: The Company will ensure that all outbound telephone solicitations transmit accurate Caller ID information, displaying [Company Name]'s name (or the name of the entity on whose behalf the call is made) and a telephone number at which [Company Name] (or the entity) can be reached. Blocking or otherwise preventing the transmission of Caller ID information is prohibited.

  13. Prerecorded Messages: Any telemarketing calls using artificial or prerecorded voice messages shall, at a minimum:

  14. ○ At the beginning of the message, clearly state the identity of the business, individual, or other entity responsible for initiating the call.

  15. ○ During or after the message, state the telephone number of such business, individual, or other entity.

  16. ○ Provide an automated, interactive voice- and/or key-activated opt-out mechanism for the called person to make an entity-specific DNC request during the message.

  17. Call Abandonment: The Company will implement measures to ensure that the call abandonment rate for telemarketing campaigns does not exceed three percent (3%) of all calls answered by a live person, measured over any 30-day period (or per campaign, if shorter). If a call is abandoned, a prerecorded identification message must be delivered within two seconds.

  18. Record-Keeping: The Company will maintain records demonstrating compliance with this Policy and applicable DNC laws, including but not limited to: copies of this Policy, records of National DNC Registry access and scrubbing, the Internal DNC List, PEWC documentation, telemarketing scripts, call detail records, employee training records, and other records as required by the TSR and TCPA, for a minimum of two (2) years, or longer if specified (e.g., five years for internal DNC requests).

  19. Employee Training: All Company Representatives involved in telemarketing activities, or the supervision thereof, will receive training on this Policy and all applicable DNC laws and regulations upon hiring and on a periodic basis thereafter (at least annually) or as needed when significant regulatory changes occur.

  20. Use of Third-Party Telemarketers: If the Company engages third-party telemarketers, it will:

  21. ○ Provide such third parties with a copy of this Policy.

  22. ○ Require contractual commitments from such third parties to comply with this Policy and all applicable DNC laws.

  23. ○ Implement reasonable measures to monitor third-party compliance.

  24. Policy Updates and Review: This Policy will be reviewed at least annually by the DNC Compliance Officer (or designee) and updated as necessary to reflect changes in laws, regulations, or Company operations.

  25. C. Responsibilities

  26. ●     DNC Compliance Officer: is designated as the DNC Compliance Officer and is responsible for overseeing the implementation and enforcement of this Policy, managing DNC lists, coordinating training, and serving as the primary contact for DNC-related matters.

  27. ●     Management: Company management is responsible for ensuring that adequate resources are allocated for DNC compliance, that Company Representatives are trained, and that this Policy is enforced.

  28. ●     Company Representatives: All Company Representatives are responsible for understanding and strictly adhering to this Policy and all associated procedures.

  29. D. Consequences of Non-Compliance

     Violations of this Policy by any Company Representative may result in disciplinary action, up to and including termination of employment or contract, in addition to any legal penalties that may be imposed on the Company or the individual.

Usage Data
